K-3 SPOUSAL VISA



The K-3 Nonimmigrant Visa allows a U.S. Citizen to facilitate the entry of their Spouse into the United States instead of waiting to process an immigrant visa through the U.S. Embassy/Consulate. The process requires the U.S. Citizen to file two petitions with U.S. Citizenship & Immigration Services (USCIS). Upon approval of the K petition, the Spouse is required to appear for a nonimmigrant visa interview at the U.S. Embassy/Consulate in their home country. Important facts about the K-3 Visa classification include the following:

1. Valid Marriage: The U.S. Citizen and Spouse must prove that there is a valid marriage.

2. K-3 Validity: K-3 nonimmigrants are admitted to the U.S. for 2 years.

3. Travel: In most circumstance, Spouses may travel outside the U.S. and return to the U.S. with a valid K-3 Visa, even while their Green Card application is pending and without first obtaining an “advance parole” approval.

4. Green Card: Once in the U.S., the Spouse is eligible to file a Green Card application.

5. Employment Authorization: The Spouse is also eligible to file and obtain an employment authorization document (EAD) to work in the U.S. while awaiting the processing of the Green Card.

6. Criminal History: USCIS may disclose any Criminal Record of the U.S. Citizen that would affect the health or safety of the Spouse or dependent children.

7. Children of Spouse: Children under age 21 are eligible for K-4 Visas to accompany the Spouse to the U.S.
